Article 1. General
1.1 These conditions apply to all agreements with HMKT Bergeijk concerning sales, delivery and guarantees of our articles and all concerning products and/or services of orders made via our site.
1.2 All pictures, drawings and data concerning weight, measurements and colours in price lists, folders and brochures are made with the greatest care. Minor differences in the data specified by Slotracewereld.nl are allowed as far as they do not discharge into a fundamentally other performance to be made by HMKT. HMKT explicitely claims the right, with due observance of the above, to make changes and improvements in the given data. This gives the client no special rights.
1.3 Only the Dutch law applies the conditions.
1.4 Deflection of the general conditions is only possible after approval by HMKT in which case the rest of the clansus if the general conditions remain operative.
1.5 HMKT has the right to change the general conditions and the contents of the webshop.
1.6 HMKT explicitely rejects any general conditions made / used by the clients.
Article 2. Proprietary rights
2.1 HMKT keeps the ownership of all products to be delivered by HMKT until full payment of the price of all products delivered or to be delivered has been received.
Article 3. Prices
3.1 Unless specifically otherwise mentioned, all prices of HMKT are in Euro (EUR) and are VAT included, formarding-charges excluded. Possible bankcharges are for the account of the customer. HMKT charges only 1x freight costs independently of the number of the goods ordered, when delivery is made at one go.
Article 4. Offers and ordering
4.1 All offers of HMKT, in whatever form, are offers without engagement, non-committing and as long as the stock lasts unless otherwise agreed.
4.2 Orders will be sent within 7 working-days after receipt of the payment.
4.3 When the customer, for whatever reason, wants to cancel an order, this has to be made known by contact form at our site within 24 hours. If this is not done, HMKT takes it that the order is valid.
4.4 The commitment between HMKT and the customer is achieved at the moment that the customer places a correct order in the webshop of HMKT.
4.5 After having received the order of the customer, HMKT shall immediately send an order confirmation by e-mail.
Article 5. Payments
5.1 Payment has to made without any discounts.
5.2 Outside the Netherlands, all payments have to be made beforehand.
5.3 We only charge 1 x freight costs no matter the number of the products ordered when the delivery is made in one time.
Article 6. Deliveries
6.1 HMKT only makes use of professional senders.
6.2 If HMKT needs additional data of the customer in order to make a correct delivery, the delivery time starts only after the client has made this data available to HMKT.
6.3 The goods are and travel for risk of the customer after leaving HMKT stores.
6.4 HMKT is allowed to deliver in more parts.
6.5 If HMKT has given a term for delivery, this is an indication. The given term is never the definitive term. The final delivery time however is not to exceed the given delivery time by more than 7 (working) days unless the circumstances are beyond our control. When this term is exceeded, the customer can hold HMKT liable by using the contact form.
6.6 HMKT cannot be held responsible for possible damage to the original packing of the products, because this damage can be a result of forwarding the product which is not done by HMKT.
Article 7. Delivery and complaints
7.1 Complaints about shoddy or incomplete deliveries have to be made known to HMKT within 48 hours after receiving the goods, by contact form.
7.2 HMKT guarantees that the goods to be delivered meet the normal demands and standards which can be expected. If shown that the demands and standards are not met, the customer can:
-return the goods in original packing within 7 working days, to be replaced by new products. Costs of freight o the new products are for the account of HMKT. We never accept unpaid return shipments, if so the goods will return to the customer at his expenses.
-return the products. Clients receive a restitution of the purchase price minus shipping costs within 7 working days after HMKT has received the goods. We never accept unpaid return shipments, if so the goods will return to the customer at his costs.
Article 8. Responsibility
8.1 Clients safeguards HMKT against all claims of third parties.
8.2 At all times, responsibility of MKT is limited to the amount of the delivery concerned, or the maximum amount HMKT could have charged to the client.
8.3 Limitation of responsibility as mentioned in this article equally applies to personnel, co-operators and all other persons HMKT has agreements with in order to carry out a delivery.
8.4 HMKT is not responsible for possible damage to the original packing of the goods to be delivered, because this damage can be made by third parties in the forwarding process.
Article 9. Circumstances beyond one’s control
9.1 If HMK cannot comply with the demands of the customer due to circumstances beyond our control, the obligations will be postponed until after those circumstances.
9.2 HMKT shall always inform the customer as soon as possible of a (possible) force majeure.
Article 10. Other regulations
10.1 Buyers of the goods of HMKT give their permission to the use of their personal data by HMKT. This personal data are exclusively for the use of HMKT in order to be able to make a delivery or to make offers and/or give additional information to the client (only if approved by the client). The personal data shall not be given to third parties
10.2 The personal data we use, are the data given by the client at the order form of the web shop of HMKT.
10.3 If the client does not want to be informed of personal offers or newsletters, this information can be stopped by contact form. HMKT shall immediately stop sending this information.
